Inquisition on body of Nicholas Grout (Trout), 17th July, 1753. Jurors
do say that the said Nicholas Trout, in simplicity, without malice,
playing with Peter Hull and seizing a gun in said Hull's hands and
pulling its muzzle towards him. She accidentally went off
without any act or knowledge of the said Hull and discharged herself
with a ball and two great shots into ye breast of said Trout, of which
he died immediately on ye spot, and quit ye gun wherewith ye same was
done was entirely in fault for not keeping her bounds, but going off

3d inst. he accidently fell from his feet against the rute of a saplin and

about or prior to 1771, leaving orator an infant of very tender years and
his widow, Jane Graham. Joseph was grandson of Joseph Walkub. In
1776 Jane married Alexander Stuart. David Stuart, son of Alexr. Stuart,
deposes 27th September, 1804, in Augusta, that his father lent Rebekah
Graham, wife of Joseph Graham, a bed. Margaret Vachub deposes, 27th

Island in the Ohio, and died in 1794. John P. Duval surveyed same Island,
and answers that there were two islands of the same name. Isaac Williams
deposes at house of Edward Stephenson in Wood Co. before Hugh Phelps &
John G. Henderson, justices, 5th October, 1801, that he first visited the
Country opposite the Muskingum in 1766 or 1767, & was frequently backward
and forward. Joseph Tomlinson says, 5th November, 1801, that in 1771 he
& his brother, Samuel Tomlinson, knew the island as Muskingum. That about
20 years ago a boat belonging to one Berkinson was landed on the Island
below mouth of Muskingum & there attacked by the Indians. He has resided
on Ohio River near mouth of Grove Creek since Spring of 1771.

Knew William Patton, formerly of Tuluaree, Parish Donagh, but many years ago went to America, and lately died there, leaving will and appendix. David Stephenson and Mathew Patton, executors, son William married to Mary Beatty. still living at Carickafaden, were married in parish of Donagh by Rev. Thomas Shawbridge, dissenting clergyman. Affiant was best man about fifty-six years ago.
Patton's heir vs. Patton's Executors.--Continued. William, soon after marriage, went to America, leaving issue one.son, viz, John Patton, who died about twenty years ago, leaving James Patton, his son, and only issue, who now lives at Carickafaden. Certificate by John Pitt Kenedy, rector of Donagh Parish, that he knows said James Patton, is about twenty-four years old, five feet nine inches high, wears his own hair dark brown, blue eyes and weighty eyebrows, of dark complexion, pretty stout, 29th August, 1801. Elizabeth Caruthers deposes that she was well acquainted with Mary Beatey, wife of William Patton, although she was called Mary Beatey, it being a custom in Ireland among poor people for married women still to retain their maiden names. Heard that William left Ireland when son, John, was infant. Was well acquainted with John. John died, leaving child by Ruth Wallace. Never heard John acknowledge the child, but it lived with him, he treated it as his child and she always understood it was his. Child lived with grandmother, Mary Beatey, until nine years old, when affiant left Ireland about eight years ago. Complainant now present is said child. 10th February, 1801. Samuel Scott deposes. Is twenty-eight years old and always acquainted with plaintiff, living in same neighborhood. Mary Beatey died December two years ago. John Patton had many relations on his mother's side. 30th May, 1801. Mathew Patton being a non-resident, order publication. Removed to Kentucky. Bill states James is only son and heir of John Patton, who was only son and heir of William Patton, late of Augusta. William left them in Ireland in 1741. Mathew's answer states that William was a distant relative of Mathew.

Joseph Watson vs. Longacre--O. S. 146; N. S. 50--Bill, 28th
November, 1807. Orator is grandson of Joseph Watson of Shenandoah,
who made will devising 300 acres to orator. Joseph, Sr's.,
children at time of will were: Orator's father, who died July,
1798; Elizabeth, who married Joseph Longacre; Hannah, who married
James Stevenson; Margaret, who married William Evans (died 1787);
Joseph became insane and his children denied the will and destroyed
it. Joseph, Jr., became of age 4th August, 1802. Bill to set up the will. Defendants
are, viz: Elizabeth Longacre (husband being dead). James Stevenson
and Hannah; John Stevenson; Wm. Evans, Sr.; Wm. Evans, Jr.; Joseph

Question is whether a deed can be recorded in General Court that is

viz: Stephen Huston and as administrator of Nathan Huston, deceased;
Mary Ann Huston, widow and administratrix of John Huston; Patty Huston,
widow and administratrix of Archibald Huston, who was son of John
Huston, deceased; Polly Huston, daughter of Archibald Huston; Walter
Huston, son of John; Peter Eyler, administrator of Joseph Huston, one of
sons of John Huston; Polly Huston, widow of Joseph Huston; Jenetta
Huston, daughter of Joseph; Julius Foster and Patsy, his wife; Joseph
Mahoy and Grizzy, his wife (Patsy and Grizzy being daughters of John);
Polly and Sophia Huston, daughters of John; Nathan, Cynthia, Jane,
George, David Huston, infant children of John; and George Huston. Previous
to 1792, John Huston, deceased, and his brother, Archibald, owned
3 tracts in Rockingham, about 300 acres on Mill Creek. John Huston's
title was derived to him by being eldest son and heir, and he agreed with
Archibald that they should sell the land and divide with their brothers,
Stephen, George and Nathaniel (?). They were sons of Archibald Huston
who died, testate, leaving part of the land to his son James, who died 1774

John Hughes vs. Jacob Swallow's representatives--O. S. 306; N. S. 109--
Bill, December, 1819. In 1803 orator purchased tract in Augusta on Piney
Run from Jacob Swallow. It was conveyed 11th March, 1785, by John
Tate to Thomas Stephenson, who died, intestate, and the land descended to
his three daughters, viz: Susannah, wife of John Cook; Mary, wife of Jacob
Swallow; wife of William Hughes, mother of orator, who died, intestate,
when orator was infant only 3 days old and he inherited 1/3 of her interest.
Mrs. Swallow died without children. Jacob moved about the State, then
went West and there died, testate. Will in Augusta dated 27th October,
1817. Paul Koontz lived in Maryland and is now dead. William Koontz
lives in Maryland. Polly Smith, wife of Jacob Smith, lives in
Indiana. William Koontz (executor of Jacob Swallow) and Sarah
Keller and her husband, Ludwick Keller, live in Rockingham. Samuel Gibson
deposes, 14th April, 1821, at house of Thomas Brown in Augusta, he
was born and raised in Pennsylvania and resided near neighbors to Thomas
Stevenson or Stinson and went to school there with his children; also knew
him in Virginia after he moved. John Huse was recognized as Thomas'
grandson by his daughter Jane (?), who married William Huse. They
were married in Pennsylvania. John is not the son of _____ Cooper, who
married Rachel Stinson. The Coopers removed from this country 20-30
years ago. David Brand deposes, as above, John was son of Mrs. Mary
Huse. Maj. William Wilson ditto, was well acquainted with William
Hughes, who said John was his son. Deed, 25th March, 1805, by Jacob
Swallow and John Cook and Susannah, heirs of Thomas Stephenson,
deceased, to John Hughes, their interest in tract on Pine Run, 200 acres.

John Sizer's Declaration, September 6th, 1832: Born in Baltimore County,
Maryland, in 1759; moved in 1770 to Prince William County. In 1777
volunteered in the Company of Capt. (afterwards Major) Ewell. On his
return in 1777 he moved to Rockingham County and volunteered in the
Company of Capt. Daniel Harrison, and at Fredericksburg was put under
the command of Capt. Adam Wallace of Rockbridge. Again enlisted in
the Company of Capt. Baverley Roy, Col. Heath's Regiment, and in
Charleston, South Carolina, was transferred to the Company of Capt. Parker.
His Company was taken prisoner and exchanged, together with Col. Heath,
Lieut.-Col. Wallace and Major Stevenson, all of Virginia, at Jamestown.
Col. Parker, commanding the Half Moon Battery at Charleston, was killed.
In 1781 he drove cattle to Yorktown; he was present at the surrender.
